Terms & Conditions

Effective Date: June 20, 2026

These Terms and Conditions (“Terms”) constitute a legally binding agreement between PlannerKart and any person accessing or using the Platform and Services.

Definitions

For the purposes of these Terms:

Platform
The website, mobile application, and related systems operated by PlannerKart.
Services
Event-related services facilitated through the Platform.
Vendor
Third-party service providers listed on or connected through the Platform.
User
Any individual or entity accessing or using the Platform.

Nature of Services

PlannerKart operates solely as an intermediary technology platform facilitating interaction and transactions between Users and independent Vendors.

Unless expressly stated otherwise in writing:

  • PlannerKart does not directly provide event management services;
  • PlannerKart does not employ Vendors as employees or agents;
  • Vendors are independently responsible for execution and delivery of services.

PlannerKart does not guarantee:

  • Continuous availability of Vendors;
  • Quality, suitability, legality, or timeliness of Vendor services;
  • Uninterrupted access to the Platform.

Eligibility

By using the Platform, the User represents and warrants that:

  • The User is legally competent to enter into binding contracts;
  • All information provided is accurate, current, and complete;
  • Use of the Platform does not violate applicable laws.

Bookings and Payments

  • All bookings are subject to Vendor confirmation and availability.
  • Pricing may vary depending on event specifications, location, vendor pricing, and market conditions.
  • PlannerKart reserves the right to revise pricing due to changes in taxes, vendor costs, or operational expenses.
  • Advance payments, deposits, or milestone payments may be required.
  • Users authorize PlannerKart and payment processors to process transactions.

Failure to make timely payments may result in cancellation of bookings without liability to PlannerKart.

User Obligations

Users shall not:

  • Provide false, misleading, or fraudulent information;
  • Use the Platform for unlawful or unauthorized purposes;
  • Interfere with Platform security or operations;
  • Circumvent the Platform to avoid payment obligations or commissions;
  • Infringe intellectual property or proprietary rights.

Vendor Responsibilities

Vendors are solely responsible for:

  • Service delivery and execution;
  • Licenses, permits, and regulatory compliance;
  • Staff conduct and safety;
  • Quality standards and timelines.

Any dispute regarding service quality or execution shall primarily lie between the User and the Vendor.

Intellectual Property Rights

All trademarks, logos, trade names, content, software, graphics, text, designs, and proprietary material on the Platform are owned by or licensed to PlannerKart and are protected under applicable intellectual property laws. Unauthorized use, reproduction, modification, or distribution is strictly prohibited.

Limitation of Liability

To the fullest extent permissible under applicable law:

  • PlannerKart shall not be liable for indirect, incidental, punitive, special, or consequential damages;
  • The aggregate liability of PlannerKart shall not exceed the amount actually received by PlannerKart for the relevant booking;
  • PlannerKart shall not be liable for Vendor defaults, cancellations, delays, negligence, misconduct, or force majeure events.

Indemnity

Users agree to indemnify, defend, and hold harmless PlannerKart, its directors, employees, affiliates, and representatives from and against any claims, liabilities, damages, losses, penalties, costs, or expenses arising out of:

  • Breach of these Terms;
  • Violation of applicable laws;
  • User misconduct;
  • Disputes with Vendors or third parties.

Force Majeure

PlannerKart shall not be liable for any delay, interruption, or failure in performance arising due to causes beyond reasonable control, including but not limited to:

  • Natural disasters;
  • Pandemic or epidemic;
  • Government restrictions;
  • Civil unrest;
  • Power failures;
  • Internet or communication disruptions;
  • Labor strikes.

Termination

PlannerKart reserves the right to suspend, restrict, or terminate User access to the Platform at its sole discretion without prior notice in case of:

  • Breach of these Terms;
  • Fraudulent or unlawful activity;
  • Conduct detrimental to the Platform or Vendors.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located at New Delhi, India.
